End User License Agreement

This End User License Agreement (“Agreement”) is a contract between you and Aquidneck Labs (“we”, “us”) for the macncheese desktop application and its updates (the “Software”). By installing or using the Software you agree to it.

1. License grant

We grant you a free, personal, non-exclusive, non-transferable license to download, install, and use the Software on the Macs you own or control. There is no fee, no subscription, and no activation. We may change or discontinue the Software, or stop distributing it, at any time.

2. Third-party models & content

The Software lets you download and import third-party AI models, each under its own license. You are responsible for complying with those licenses and for how you use them. You are solely responsible for the content you generate and for ensuring it’s lawful. We don’t review or claim ownership of your output.

3. Restrictions on use

Except where this restriction is prohibited by applicable law, you agree not to:

• decompile, reverse-engineer, disassemble, or modify the Software, or attempt to derive its source code;
• resell, rent, lease, sub-license, distribute, or otherwise commercially exploit the Software for profit;
• remove, obscure, or alter any copyright notice, trademark, or other proprietary marking in the Software.

4. Prohibited and illegal uses

You may use the Software only for lawful purposes. You agree not to use it for any illegal activity, or in any way that violates applicable local, state, national, or international law or regulation — including creating unlawful content. This license terminates immediately and automatically if you use the Software for any illegal purpose, and you must stop using it at once.

5. “As is” — no warranty

The Software is provided “AS IS” and “AS AVAILABLE,” without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We don’t warrant that the Software is error-free or that any particular output will meet your expectations.

6. Limitation of liability

To the fullest extent permitted by law, Aquidneck Labs will not be liable for any damages whatsoever — direct, indirect, incidental, special, punitive, or consequential — arising from or related to the Software, including loss of data, loss of profits, business interruption, or computer or hardware failure. This applies even if we have been advised of the possibility of such damages. You install and use the Software entirely at your own risk.

7. Termination

This Agreement ends if you breach it, including immediately upon any illegal use as described in section 4. On termination you must stop using the Software. Sections that by their nature should survive (warranty disclaimers, liability limits) survive termination.

8. Governing law

This Agreement is governed by the laws of the United States and the state in which Aquidneck Labs is established, without regard to conflict-of-laws rules.
